I just got a call from the appeals specialist (Wow! They actually called ME!).  She received my fax; however the decision mailed did not have my SSN on it.  She said they had to look it up which has delayed things.  So I refaxed and gave her my SSN.  Make sure when you fax that your SSN is somewhere on it for them....</description>

First, congrats on the win!  Not just another step in the unemployment mayhem, but a HUGE step.

After my hearing, I waited for the mail lady to come every single day.  The minute she walked away my hand was in the mailbox, just to be disappointed again.  Then it finally came, two weeks ago today.  I remember how nervous I was to open it, then how happy when I did.  I know it seems crazy to get so emotional about it, but when it&#039;s your life and livelihood in the hands of your ex employer&#039;s word and the EDD, that is a recipe for disaster or better yet- insanity!

On Friday, March 5th, I called (for the second time since I won) and spoke to and EDD rep.  After telling me that my file still had no change, he told me it could take up to three weeks.  When I asked him why, you could hear him chuckle and then he said &quot;Because we are backed up&quot;.  

&quot;Really?!!!  You are backed up?  &quot;Mr. I have a job&quot; I would switch places with you in a heartbeat!  It&#039;s been 8 months for me waiting on you guys to figure out that I should have been paid all along.&quot;  Those were my thoughts, but I chose not to say them (this time) .

I asked him what I am supposed to do, just wait?  Then he suggested I fax over my decision to the &quot;appeals specialist&quot; and he gave me a 909 fax number.  Well that is not local for me (one county over), so I looked up the local office fax number from this site and I faxed my decision to both numbers!  I am still not feeling very confident with the fax making it go that much faster.  I&#039;ve seen stories from both sides of the coin.  One person on here was told to fax, and then a month later EDD said they still have no update.  Another person (Rikki) faxed, waited, called them and then found success.

I would find your local office from the list here on this site, and fax over your decision.  Make it ATTN: Appeals Specialist.  Then when you call EDD and they tell you to fax, it&#039;s already done.  

I think the key is to keep calling and stay on top of them.  Both times I have called, the EDD rep was vague and not very helpful; however, maybe if I keep calling I will get a hold of one of the reps that actually is knowledgable and courteous.  One can hope!

Thanks again.  It is just so frustrating, the waiting game.  It has already been 8 months with no income, and I&#039;m sure if I owed the state money they would be all over my rear!

I&#039;ve already lost so much, as I&#039;m sure so many others have.  Getting evicted, moving back in with my parents temporarily, all the past due utilities, my car registration just expired, all my stuff in storage, having to find new homes for my beautiful pets, etc. etc. etc.  

Although I can say how satisfying it is to win the appeal and have the judge side with me, it doesn&#039;t help when you go for an interview and they ask :&quot;reason for leaving your last employer&quot;.  

Has anyone who won their appeal thought about filing a wrongful termination case?  I do not want my job back there, but boy the pain and suffering!

Also Rikki, did they pay you one big check or lots of little ones?
